HEALTH FRAUD: Abuse Control Program Annual Report

Healthcare Fraud and Abuse Control Program Annual Report Released

In Fiscal Year (FY) 2022, the Department of Justice (DOJ) opened more than 809 new criminal healthcare fraud investigations. Federal prosecutors filed criminal charges in over 419 cases involving at least 680 defendants. More than 477 defendants were convicted of healthcare fraud related crimes during the year. Also, in FY 2022, DOJ opened more than 774 new civil healthcare fraud investigations and had over 1,288 civil healthcare fraud matters pending at the end of the fiscal year. 

Federal Bureau of Investigation (FBI) investigative efforts resulted in over 499 operational disruptions of criminal fraud organizations and the dismantlement of the criminal hierarchy of more than 132 healthcare fraud criminal enterprises. In FY 2022, investigations conducted by HHS’s Office of Inspector General (HHS-OIG) resulted in 661 criminal actions against individuals or entities that engaged in crimes related to Medicare and Medicaid, and 726 civil actions, which include false claims, unjust-enrichment lawsuits filed in Federal district court, and civil monetary penalty (CMP) settlements. HHS-OIG excluded 2,332 individuals and entities from participation in Medicare, Medicaid, and other Federal healthcare programs.

DST: Daylight saving time, also known as daylight savings time or daylight time, and summer time, is the practice of advancing clocks during warmer months so that darkness falls at a later clock time.

DAILY UPDATE: ChatGPT Anniversary

ChatGPT was launched nearly a year ago, in November 2022. Powered by a large language model trained on 570 gigabytes of internet data (300 billion words), the chatbot can generate text that eerily mimics human speech—but with far more information at its disposal than an actual person. Amazon is not the only company using AI to create theoretically better ads.

  • Meta announced its version of an ad generator last month, promising advertisers “a new era of creativity that maximizes the productivity, personalization, and performance” of campaigns.
  • Google says its product will allow the future of advertising to evolve.
  • TikTok has Creative Assistant, which “draws information from a wealth of TikTok-focused creative knowledge, providing you with the most relevant responses for when you’re creating ads.”

But, ChatGPT is not the same for mental health. Experts are warning that while chatbots can offer basic mental health support, they’re not equipped to provide clinical support and can raise thorny issues.

  • Ethics: Therapists are trained and licensed and must maintain a certain standard of care; a chatbot isn’t and doesn’t.
  • Privacy: When you ask a chatbot a question, you could be putting sensitive information on the internet.
  • Safety: A chatbot can give false information (more on that below) or provide harmful instructions.

ChatGPT in Education:

  • The bar exam: GPT-4 was in the 90th percentile with a score of 298 out of 400. GPT-3.5 came in the 10th percentile.
  • The SAT: GPT-4 scored 1400 out of 1600, ranking in the 89th percentile of test-takers. GPT-3.5 scored 1260.
  • AP exams: GPT-4 received a 5 on Art History, Biology, Environmental Science, Macroeconomics, Microeconomics, Psychology, Statistics, US Government, and US History, according to OpenAI. GPT-3.5 received a 5 only on Art History and Psychology.
  • Sommelier exams: GPT-4 has also passed the Introductory Sommelier, Certified Sommelier, and Advanced Sommelier exams with scores of 92%, 86%, and 77%, respectively. GPT-3.5 had a less discerning palate, earning marks of 80%, 58%, and 46%.

“WeWork”: Officially Bankrupt

WeWork, the coworking company just filed for Chapter 11 bankruptcy protection in New Jersey after years of struggles that began with a failed IPO in 2019. It aborted the IPO after investors got a look at its finances and just how much power WeWork’s eccentric founder Adam Neumann possessed.

PEPFAR’s Uncertain Future for AIDS Relief

An impactful government program is facing an uncertain future. PEPFAR—an acronym for the President’s Emergency Plan for AIDS Relief—was created by former President George W. Bush in 2003 and is credited with saving 25 million lives around the world. Through the program, the US government has invested more than $100 billion in treatment for HIV-AIDS and related illnesses by providing training, medical infrastructure, and antiretroviral drugs. PEPFAR remains the largest commitment by a country to confront a single disease, according to KFF.

Since its inception, PEPFAR has been renewed every five years with bipartisan support. But that wasn’t the case in 2023, as lawmakers let the program expire at the end of September.

RUDE PATIENTS: To Laboring Physicians?

A spike in rude behavior emerged as one of the pandemic’s many societal consequences and has not receded alongside the public health crisis. The uptick in poor behavior is likely driven by increased stress and isolation from society, The Atlantic’s Olga Khazan reported in 2022. In many cases, these stressors mean people are easily set off when encountering innocuous requests, Keith Humphreys, PhD, a psychiatry professor at Stanford University, told The Atlantic

The trend has hit healthcare hard. Hospitals and health systems nationwide have reported an uptick in disrespectful, discriminatory, or violent behaviors from patients since the pandemic. Nearly 24 percent of physicians reported experiencing workplace mistreatment in 2020, including verbal mistreatment or abuse, according to a study published in JAMA Network Open.

M&As: A New Guidelines Draft

Last month, the FTC and DOJ jointly released a draft of new guidelines they will use to evaluate potential mergers and acquisitions (M&As).

The guidelines include 13 principles the agencies will follow when scrutinizing deals. The principles stipulate that mergers may not “entrench or extend a dominant position,” eliminate competition between firms, increase concentration in an already concentrated market, or prevent new players from entering a market. The guidelines will be finalized following a 60-day public comment period.

The proposed rules reflect a return to pre-2010 guidelines on concentration, the Wall Street Journal reported, noting that they’d apply to deals that resulted in firms having a market share of 30% or more. The new guidance may give the FTC and DOJ, which have filed numerous antitrust actions, more leeway to go after deals.

The already booming market for weight loss treatments like Ozempic might get even bigger as drug companies seek to make them available for children. The CDC estimates that ~20% of kids 6+ in the US have obesity, and manufacturers are working to make their weight loss drugs available for that age group.

According to Bloomberg, Novo Nordisk is testing its Saxenda in kids as young as six, and Eli Lilly is getting ready for similar trials of Mounjaro. That could give the companies lifelong customers since the drugs only keep weight off as long as people take them—and Goldman Sachs’s recent estimate that the drug category would make $100 billion by 2030 didn’t even take sales to children into account.

TRANSFER ON DEATH: TOD Deeds

What Is a Transfer on Death (TOD) Deed?

TOD deeds are legal documents that can be filed in local land records offices, and do not require the notice of the beneficiary, though it’s probably a good idea to inform them. Each state has its own requirements as to what the deed entails. TOD deeds are offered in 27 states (and D.C.).

These deeds are revocable once filed. Beneficiaries have no ownership claim to your property while you’re still alive. You maintain full control of the property, including responsibility for any mortgage debt, taxes, liens and the like. Once you pass away, the property will transfer to your named beneficiary, along with any debts attached to it.

Pros and Cons of a Transfer on Death Deed

Before signing a transfer on death deed, there are a few things to keep in mind.

Pros

  • You retain ownership while you’re still alive. Your beneficiary only takes over once you pass away; until then, you make all decisions about your property, and can even sell it if you choose. This makes a TOD deed a better choice than, say, adding someone as a joint owner on your property. (In that case, you would need their permission before selling, refinancing, mortgaging or even improving the home.)
  • It is revocable. If you choose to withdraw or revoke your transfer on death deed, you can do so at any time. You can also replace an existing TOD deed with a new one, if desired.
  • It’s simple. Establishing a transfer on death deed is easy. It just requires signing the document and filing with your county land records office. You don’t even need to let the beneficiary know you’ve done it. 
  • Anyone can be named you beneficiary. You can use a transfer on death deed to pass property to anyone when you die. This includes family members, friends, other loved ones or even charitable causes.

Cons

  • Joint ownership takes precedence. If the property is jointly owned with someone else, that ownership supersedes a TOD deed. The property will instead transfer to the other owner if you pass away. Once they also pass away, the TOD deed will go into effect (if still valid).
  • If your beneficiary dies first, your property goes to probate anyway. If you pass away along with or after your beneficiary, and don’t have a backup beneficiary named, your property will go through probate with the rest of your estate.

These loans don’t have set repayment schedules but they do accrue interest. Here’s what you should know about borrowing from an insurance policy:

PROs:

  • Easier to secure than a bank loan, especially if you have bad credit.
  • May only take a few days to receive funds.
  • Interest rates may be lower than other loans.

CONs:

  • You may need to pass a physical to qualify for an insurance policy.
  • Policy loans can decrease the death benefit.
  • Premiums can run significantly higher than comparable term policies

HACKED: 23andMe

More than 7 million 23andMe customers were the victims of a data breach, with the hackers specifically targeting users of Ashkenazi Jewish ancestry. The data includes users’ names, profile photos, genetic ancestry results, date of birth, and geographical location. The hackers are attempting to sell the data, asking for between $1 and $10 per account, depending on how many accounts a buyer wants to purchase.

How’d they do it? By “credential stuffing”—acquiring the login credentials from one site and using them on other sites in order to gain access to sensitive information. 23andMe reported the incident to law enforcement and is asking all customers to change their passwords and use two-factor authentication.

STRIKE: Kaiser Permanente Strikes

More than 75,000 workers employed by Kaiser Permanente, one of the largest nonprofit healthcare providers in the US, plan to walk off the job for three days—starting today.

Healthcare workers across the industry are experiencing challenges, which Kaiser acknowledged in response to the looming strike. According to a statement by the company, up to two-thirds of healthcare staff everywhere are burnt out. That’s exacerbated by the issues Kaiser employee unions say they’re striking over, including:

  • Acute staffing shortages: Short-staffing is a common problem in healthcare, but union members say that it has worsened between the pandemic and the Great Resignation—and patient safety is in danger.
  • Wage increases: The union wants what it describes as competitive compensation that accounts for the increased cost of living: a $25/hour wage floor and increases between 6.25% and 7% over the next four years.

Kaiser insists it pays a decent and denied claims of being short-staffed, saying it hired 22,000 people already this year.

OCTOBER 4th: National “Emergency Alert” Day

On Wednesday at 11:20 am and 2:20 pm 2023, Eastern, most Americans will simultaneously feel their cellphones vibrate, hear them make a loud sound and see a push alert pop up on their screens. Most radio and television stations will broadcast an alert at the same time for about one minute.

It’s a test of the national emergency alert systems, which are designed to let the government reach hundreds of millions of people in the United States immediately if there is a disaster affecting the entire country. The Federal Emergency Management Agency and the Federal Communications Commission are conducting the coordinated test to see if the technology is working as designed and if any improvements are needed.

The sound is a unique tone that probably will interrupt classes and meetings, reveal the locations of hidden phones, and jar anyone not expecting it. The test itself is already leading to baseless conspiracy theories about how the powerful communication tool could be abused.

There is no national emergency, no reason to panic and nothing you need to do about the alerts.

It is, as the text will say, just a test.

Hospitals Say Bye-Bye?

Medicare Advantage provides health coverage to more than half of the nation’s seniors, but a growing number of hospitals and health systems nationwide are pushing back and dropping the private plans altogether. Among the most commonly cited reasons are excessive prior authorization denial rates and slow payments from insurers. Some systems have noted that most MA carriers have faced allegations of billing fraud from the federal government and are being probed by lawmakers over their high denial rates.

“It’s become a game of delay, deny and not pay,” Chris Van Gorder, president and CEO of San Diego-based Scripps Health, told Becker’s. “Providers are going to have to get out of full-risk capitation because it just doesn’t work — we’re the bottom of the food chain, and the food chain is not being fed.” Van Gorder said the health system is facing a loss of $75 million this year on the MA contracts, which will end December 31st for patients covered by UnitedHealthcare, Anthem Blue Cross, Blue Shield of California, Centene’s Health Net and a few more smaller carriers.

Cigna to Pay $172M Over Alleged Medicare Advantage Fraud

The Cigna Group will pay $172.3 million to resolve allegations that it violated the False Claims Act by submitting incorrect Medicare Advantage patient data to CMS to receive higher payments from the agency. The U.S. Attorney’s Office for the Eastern District of Pennsylvania alleged Sept. 30 that Cigna also falsely certified that the submitted data was accurate, failed to withdraw the “untruthful” data, and did not repay CMS.

Cigna will use $135.3 million from the settlement to resolve the allegations from the Justice Department. The remaining $37 million will resolve allegations related to unsupported diagnoses for Medicare Advantage enrollees that received in-home services from Cigna. As part of the settlement, Cigna has entered into a five-year accountability and auditing agreement with HHS’ Office of Inspector General, which will require company executives and board members to certify Cigna’s compliance moving forward. The payer must also conduct annual risk assessments and submit to independent risk adjustment audits.

SEC: New Cyber-Security Regulations

The SEC’s new cybersecurity regulations went into effect last week. Most companies are “largely ready” to comply, Matt Gorham, senior managing director and leader of PwC’s Cyber & Privacy Innovation Institute, told CFO Brew, “but that doesn’t mean there isn’t work to do.”

As their companies’ finance leaders, CFOs are instrumental in determining whether a cybersecurity incident is material, but they have other roles to play as well. Gorham shared his advice for how CFOs can help their organizations comply with the new regs. Now, aAs a reminder, the regulations consist of what Gorham refers to as three “buckets.” Companies that file with the SEC are required to:

  • Declare any material cybersecurity incidents to the SEC on Item 1.05 of Form 8-K within four business days of determining materiality
  • Disclose information about their cyber risk management and strategy on a new section of the 10-K called Item 1C
  • Disclose information about their boards’ and management’s role in overseeing cybersecurity risk

The first two “buckets,” Gorham said, will likely require the most work to comply with.

The “New” Dental Support Organization Business Model

Watch out, private practice ownership. According to HealthcareBrew, Dental Support Organizations (DSOs) are the hot new business model for dentistry.

DSOs are companies that take on all the business-related tasks necessary to run a dental practice, like IT support, accounting and billing, marketing, and facility maintenance, Lisa Ward, VP of communications at industry trade group the Association of Dental Support Organizations, told Healthcare Brew.

A DSO can own the dental practice it operates, or a private practice can contract with a DSO. Some DSOs are owned by a group of dentists, but private equity firms own many large DSOs, according to the Academy of General Dentistry.

The idea behind a DSO is that the “dentist can focus on patient care and not have to worry so much about the business side,” Ward said.

The DSO business model was created in 1975 but didn’t become popular until the 1990s, as dentists graduated with piles of student debt and found it hard to open their own practice, according to Huron Consulting Group.

Today, 10.3% of dentists are affiliated with a DSO, per investment banker Harris Williams. In 2020, 30% of dental school seniors said they planned to join a DSO-affiliated practice, compared to 12% in 2015, a survey from the American Dental Education Association found.

The rise in popularity of DSOs has brought about the decline of private practice ownership. In 2021, the number of dentists who owned their practices fell to 73%, according to research from the ADA.

LAWSUITS: Amazon, Facebook and Google

Stocks are diving recently, giving the Dow its worst day since March as new data on declining home sales and consumer confidence gave investors the recession-could-be-coming jitters again.

And, Amazon dipped after the FTC filed its long-awaited anti-monopoly suit against the company. The FTC and 17 states delivered a sweeping lawsuit accusing the trillion-dollar e-commerce company of being an illegal monopoly. It’s the fourth lawsuit levied by the FTC against Amazon this year and easily the one with the most profound consequences for US antitrust legislation. The FTC and state attorneys general allege that Amazon abused its power by punishing sellers if they offered lower prices on other platforms, a practice that led to higher prices for consumers. Sellers on the marketplace were also allegedly coerced to use Amazon’s logistics and advertising services or face penalties like reduced visibility.

Meanwhile the FTC is also looking to break up both Google and Facebook but it is unclear if that’s the real goal here. The FTC asked for a permanent injunction to stop alleged misconduct. Bad news for Google which celebrates its’ 25th birthday today.

FQHC: Medicaid Renewal Barriers

For almost 60 years, federally qualified health centers (FQHCs) have played a key role in providing medically underserved populations and areas with affordable and quality care, regardless of a person’s ability to pay.

Now these nonprofit community health centers are on the front line as states work through a three-year backlog of Medicaid eligibility determinations—a process that was put on hold during the Covid-19 pandemic after the federal government offered states higher reimbursements in exchange for keeping recipients enrolled in Medicaid programs.

As many as 17 million people could lose Medicaid coverage due to ineligibility or other renewal barriers during the unwinding period, which began April 1, according to KFF estimates. At least 5.4 million people have lost Medicaid coverage as of August 23rd according to data from 45 states and Washington, DC, KFF reported.

With FQHCs caring for an estimated one in six Medicaid recipients, community health centers across the US have beefed up their efforts to help patients through the transition and brace for any potential fallout. About 86.8 million people were enrolled in Medicaid nationwide as of the end of May, according to federal estimates.

Companies’ ESG efforts can prove profitable when it comes to M&As, according to a recent KPMG US ESG survey, which showed that 41% of business leaders see ESG as a major source of financial value during M&As.

NYC Health + Hospitals/Bellevue is seeking approval to expand its outpatient dental clinic, according to Healthcare Brew and plans filed with the state this week.

The $830,000+ renovation of Bellevue’s clinical space would double the number of dental chairs from three to six, and allow the Manhattan public hospital to “meet the existing demand for dental services, meet the training requirements of the dental general practice residency program, and allow for additional growth to meet the oral health needs of the under served and uninsured population in the community,” according to the application.

Bellevue reported that each of its dental chairs has an average annual utilization rate of 2,000 visits, or about 6,000 total visits a year.
