Three healthcare industry groups—America’s Health Insurance Plans (AHIP), the American Medical Association (AMA), and the National Association of Accountable Care Organizations (NAACOS)—released the 36-page playbook on July 25th, 2023. Adoption of the best practices in the playbook is voluntary; the playbook is intended to encourage the adoption of value-based care arrangements in the private sector, according to a news release from the three groups.

Under a value-based care model, providers are reimbursed based on patient outcomes rather than the quantity of services provided like in the traditional fee-for-service model. The value-based care model has been around since the late 1960s. But, widespread adoption has been slow—less than half of the primary care physicians said in a 2022 survey from the Commonwealth Fund that they had received any value-based payments.

The Emerging Role of Chief Diversity Officer [CDO] 2.0

My history

I came of age on the mean inner city streets of Baltimore, Maryland and developed a special interest in diversity, inclusion and urban renewal at a young age.

Today, I resonate with the identity of human capital educational leadership; small classes or teams; engaged students and stakeholders; parents and teachers; research and development; and a motivated staff inculcating life-long learning initiatives and critical thinking skills.

Career

Yet, I am not a career opportunist seeking incremental advancement through the halls of academia. Rather, I am a culturally sensitive and bi-racial physician-executive who senses there are deep, but often untapped, human resources embedded within many universities. If true; they are best released by an externally recruited champion of diversity and inclusion.

A Chief Diversity Officer [CDO]; if you will.

This includes a respect for values that celebrate the unique attributes, characteristics and perspectives that make each person who they are; ethnicity; gender; gender identity; language differences; nationality; parental status; physical, mental and developmental abilities; race; religion; sexual orientation; skin color; socio-economic status; work and behavioral styles; the perspectives of each individual DNA shaped by their nation, experiences and culture—and more.

Even when people appear the same on the outside, they are different.

Importantly, such inclusion includes a strategy to leverage diversity.

  • Diversity always exists in social systems.
  • Inclusion, on the other hand, must be created.

In order to leverage diversity, an environment must be created where people feel supported, listened to and able to do their personal best; for example:

The BAKKE DECISION

Historically, and for me, an important ruling on affirmative action by the Supreme Court in 1978 was the BAKKE Case. Allan Bakke, a white man, was denied admission to a medical school that had admitted black candidates with weaker academic credentials. Bakke contended that he was a victim of racial discrimination. The Court ruled Bakke had been illegally denied admission to the medical school, but also that medical schools were entitled to consider race as an admission factor.

My story

As Department Chair and Residency Director at a local hospital, I was credited with accepting the first women residents and African Americans into our post-graduate education and surgical training program.

So, at this level of blended pedagogy, andragogy and heutagogy, my mission is to be a modern guide on the side; not bombastic sage on the stage. Moreover, this CDO 2.0 position holds special gravitas in order to set the tone for the future growth of inclusion and diversity thru example; in words and deeds.

Assessment

Frankly, I don’t see the CDO role as a mere “job”. It is a calling that requires a “hands-on” ambassador — helping to advise and lead in all related matters. As the sage once opined:

There is no limit to what you can accomplish if you don’t care who gets the credit!

What is Financial CARRIED INTEREST?

Carried interest, or carry, in finance, is a share of the profits of an investment paid to the investment manager in excess of the amount that the manager contributes to the partnership, specifically in alternative investments (private equity and hedge funds).

In small businesses that are not blind pools, such as single property real estate, the investment manager often funds the business prior to the formation of the partnership. It is a performance fee, rewarding the manager for enhancing performance. The structure also takes advantage of favorable tax treatment in the United States.

However, critics of carried interest want it to be reclassified as ordinary income – not capital gains – to be taxed at the ordinary income tax rate. Private equity advocates argue that the increased tax will subdue the incentive to take the kind of risk that is necessary to invest in and manage companies to profitability.

HEALTH INSURANCE COSTS: Employer Sponsored Shares Up

The average cost of a health insurance plan offered through an employer rose 7% this year, to $23,968 for family plans and $8,435 for individuals, according to a new survey from the private health foundation KFF.

The jump—the highest since 2011—was driven by inflation, as well as higher wages for healthcare workers and hospital system mergers, health policy experts say. Here’s what it means for employers and the 150+ million Americans who get insurance through work:

  • The increase amounted to ~$500 more out of pocket for family plan-holders, and $75 more for solo riders—further squeezing consumer spending power, which is already constrained by wages that haven’t caught up to high inflation.
  • Employers often bear the brunt of increased health spending because, in the interest of staying competitive, they’re wary of offloading too much of the rising costs onto their workers. That’s likely why deductibles haven’t grown much in the past five years.

The average net worth of someone younger than 35 years old is $76,300, as of 2019. From there, average net worth steadily rises within each age bracket. Between 35 to 44, the average net worth is $436,200, while between 45 to 54 that number increases to $833,200. Average net worth cracks the $1 million mark between 55 to 64, reaching $1,175,900.

Average net worth again rises for those ages 65 to 74, to $1,217,700, before falling to $977,600 for someone over age 75.

PRIVATE COMPANIES: Raising Capital is Hard ~ No Very Tough!

The markets are down again and stocks continued their September slump with tech companies getting hit especially hard as investors fretted about another possible Fed rate hike because of data showing prices for manufacturing and services trending upward. It was a mixed bag for the meme stock faithful, with AMC hitting an all-time low after releasing a plan to sell new shares and GameStop rising after-hours thanks to better-than-expected sales last quarter.

This all may demonstrate that private companies looking to fund growth in this high-interest rate environment are facing a tough time raising capital amidst falling valuations, according to a new Deloitte survey.

The problem is particularly acute for smaller companies. Many of the companies challenged by capital raising saw themselves putting out the “For Sale” sign within the next six months, which could lead to an M&A boom later this year.

“The No. 1 largest factor that people saw as a challenge or a barrier was a decrease in valuations of their business,” Wolfe Tone, vice chair and US and Global Deloitte Private leader, told CFO Brew. “Clearly, increasing interest rates and pricing was closely behind that. MEDICARE ADVANTAGE PLANS: Part C Plans Down AS Cigna Pays Up?

Hospitals Say Bye-Bye?

Medicare Advantage provides health coverage to more than half of the nation’s seniors, but a growing number of hospitals and health systems nationwide are pushing back and dropping the private plans altogether. Among the most commonly cited reasons are excessive prior authorization denial rates and slow payments from insurers. Some systems have noted that most MA carriers have faced allegations of billing fraud from the federal government and are being probed by lawmakers over their high denial rates.

“It’s become a game of delay, deny and not pay,” Chris Van Gorder, president and CEO of San Diego-based Scripps Health, told Becker’s. “Providers are going to have to get out of full-risk capitation because it just doesn’t work — we’re the bottom of the food chain, and the food chain is not being fed.” Van Gorder said the health system is facing a loss of $75 million this year on the MA contracts, which will end December 31st for patients covered by UnitedHealthcare, Anthem Blue Cross, Blue Shield of California, Centene’s Health Net and a few more smaller carriers.

Cigna to Pay $172M Over Alleged Medicare Advantage Fraud

The Cigna Group will pay $172.3 million to resolve allegations that it violated the False Claims Act by submitting incorrect Medicare Advantage patient data to CMS to receive higher payments from the agency. The U.S. Attorney’s Office for the Eastern District of Pennsylvania alleged Sept. 30 that Cigna also falsely certified that the submitted data was accurate, failed to withdraw the “untruthful” data, and did not repay CMS.

Cigna will use $135.3 million from the settlement to resolve the allegations from the Justice Department. The remaining $37 million will resolve allegations related to unsupported diagnoses for Medicare Advantage enrollees that received in-home services from Cigna. As part of the settlement, Cigna has entered into a five-year accountability and auditing agreement with HHS’ Office of Inspector General, which will require company executives and board members to certify Cigna’s compliance moving forward. The payer must also conduct annual risk assessments and submit to independent risk adjustment audits.

What’s in a Medical Practice Professional Name?

A medical practice name should be easy to say, hear, spell, and remember-unlike prescription drugs. It should be appealing and resonate with your target patient base. Here are some common naming methods for small to medical medical practices use.

We, and most experts, recommend against naming a new medical practice with your own name because it limits future growth and you may lose the benefits that a more descriptive name would bring. Your business name will likely be incorporated using your practice’s name, although larger (multi-specialty group) practices may use a more general name for the entire enterprise; and then having multiple “dba’s” (”Doing Business As”) for the individual practices under the umbrella.

It is important to discuss these options with an attorney if you believe this arrangement has advantage; others find it confusing. Usually, your medical specialty can be used as a base-name, and then some
descriptor to differentiate it from local competing practices. Selecting a name like “The Medical Allegiance Partners” does not indicate that medicine is your service. And, you should select a name that will hopefully grow with you into a larger enterprise.

For example: You are a solo doctor, but are pretty sure you’ll take on one or more partners in the future? Then besides not naming your practice after yourself, you may choose to add “Group” or “Partners” to your name initially even if you’re the only doctor.

Moreover, is there any possibility you’ll open a second office in another town? Naming your medical practice something like the ”Apple Street Internal Medicine Group” may not make sense when your second office is opened on Main Street in a nearby city, in a few years.

Several years ago a group of highly trusted and deeply experienced financial services professionals and estate planners noted that far too many of their mature physician clients, using traditional stock brokers, management consultants and financial advisors, seemed to be less successful than those who went it alone. These Do-it-Yourselfers [DIYs] had setbacks and made mistakes, for sure. Carried interest, or carry, in finance, is a share of the profits of an investment paid to the investment manager in excess of the amount that the manager contributes to the partnership, specifically in alternative investments (private equity and hedge funds).

In small businesses that are not blind pools, such as single property real estate, the investment manager often funds the business prior to the formation of the partnership. It is a performance fee, rewarding the manager for enhancing performance. The structure also takes advantage of favorable tax treatment in the United States.

However, critics of carried interest want it to be reclassified as ordinary income – not capital gains – to be taxed at the ordinary income tax rate. Private equity advocates argue that the increased tax will subdue the incentive to take the kind of risk that is necessary to invest in and manage companies to profitability.

NAHUC: Happy “Health Unit Coordinators” Day

Today is Health Unit Coordinators Day, It is a day to celebrate the vital behind-the-scenes work these healthcare professionals do. Health unit coordinators act as a liaison between all the departments in a healthcare facility, helping to check in patients, maintain patient records, order supplies, and more.

Myrna LaFleur, who became the NAHUC founding president, invited several interested persons to meet with her in Phoenix, Arizona, on August 23, 1980, to discuss the formation of an association for health unit coordinators. This was the first meeting and resulted in selecting the name of the association. Each year thereafter, August 23 has been declared Health Unit Coordinator Day by many mayors and governors nationwide, who issue proclamations declaring August 23rd “Health Unit Coordinator Day”. Beginning in 2017, NAHUC expanded the recognition period to a full week: August 23-29th.

It’s National Report Upcoding Fraud Day, an initiative started in 2017 to support whistleblowers of Medicare fraud, which costs the US billions of dollars each year. If you need any encouragement to report suspected healthcare fraud (like upcoding or inflated Medicare reimbursement claims), here’s your chance.

What Is Upcoding?

Upcoding is defined as having a doctor or billing person assign an inaccurate billing code to a medical procedure or treatment. It’s done to increase the reimbursement to that physician.

Beyond that, CPT codes are 5-digit codes that tell billing and insurance companies what was done to you while in that physician’s care. It may sound straightforward, but with around 7,800 codes in use, it isn’t hard to get things mixed up or to miss the fact that they overcharged you for a service.

Sometimes the mistake is made in error. In other situations, the office or hospital may mix it up intentionally. Most often, intentional miscoding happens when the facility is billing Medicaid or Medicare. Again, this may not seem like a big deal for you since the government covers it, but it may still affect your ability to get the healthcare that you need.

Hesch and a passionate advocate for whistleblowers, created the day for anyone looking to report healthcare fraud. He wanted to make it easier, so everyone could get the process right. The day generates awareness and detailed steps on how the general public can report unethical healthcare providers. Fraudsters siphon off $65 billion each year in Medicare fraud through inflated reimbursement claims. Upcoding is one of the most rampant types of healthcare fraud that must end.Hesch draws on his 15 years as an attorney in the D.O.J. to support and encourage whistleblowers to come forward. The most successful claims have two things in common – facts and the use of proper reporting channels. National Report Upcoding Fraud Day aims to empower anyone with a legitimate case for claims.

SEC: Money Market Fund Reforms

  • SEC money market fund reforms: On July 12, 2023 the SEC released new rules intended to decrease the risk of runs on money market funds (MMFs). MMFs must charge liquidity fees if their daily net redemptions exceed 5% of their net assets, or if their boards deem it necessary, and must maintain a liquidity buffer of at least 25% of their total daily assets and at least 50% of their weekly assets. MMFs are also no longer allowed to use “gates” to temporarily suspend redemption!

In more than 118,000 real transactions at the university bookstore, buyers tended to slap their plastic on the counter for school supplies but pay with cash for “harder-to-justify” items like a stuffed plush mascot. And when asked how they’d pay for a hypothetical Reiki session, participants leaned toward credit card when the treatment was described as doctor-recommended but toward cash when they were told it was just an impulse purchase.

Any New Year typically brings to mind the passage of Father Time. And, it’s hard to believe I will be finishing up my current endowed R&D sabbatical after the Summer semester.

It means searching for a new faculty appointment to continue my passion for: [1] classroom teaching and junior faculty mentorship [2], university PR, outreach, promotion and grant-funding; and of course [3] more research, development, books and publications.

This competitive scholarship ethos is AKA the triad of success: “being a guide on the side – not a sage on the stage” AND “no margin – no mission” AND “publish or perish.

Employment and Subject Matter Expertise

Now, as a consummate team player, I’ve served as adjunct, to visiting, to full distinguished professor – and as department chair, to endowed chairman, online MOOC Dean and professor-of-the-practice.  Areas of specialization include: public and population health policy, management and administration; health economics, finance and insurance; and medical capitalism, innovation and free-enterprise at the graduate or doctoral levels.

And, as a former surgeon and clinician who also trained in Europe, and devotee of Nobel Laureate Ken Arrow PhD, I’m a global inter-disciplinarian within the health care industrial complex that may soon comprise 20% of domestic GDP.

Location – Location – Location

I’m pretty much private or public [mid-size] school agnostic, but prefer the Southeast, Northeast and Midwest in a livable city; with a 9-10 month faculty appointment.

But, I wouldn’t rule out a 12-month business school, or public health sciences type Dean position, as long as it is not totally administrative. A founding department chair, or inaugural deanship, would be near perfect; 24/7/365.

Crowd-Sourcing a Job?

So, I am crowd-sourcing this new job search as an emerging trend. Moreover, crowd-funding health insurance, and crowd-sourcing medical and diagnostic care is an emerging HIT trend. In fact, it’s the R&D equivalent of my current Health Dictionary Series™ WIKI project. It’s an experiment!

MEDICAL MALPRACTICE : Update on Physician Rates of Liability

About one in three physicians reported that they’ve been sued for medical malpractice during their career, a new study from the American Medical Association (AMA) found.

The study analyzed 14,000 responses from AMA Physician Practice Benchmark Surveys between 2016 and 2022. The longer a physician works in the industry, the higher their risk of getting a malpractice claim.

In summary, almost half of physicians over the age of 54 have been sued in their career, versus 9.5% of physicians younger than 40 years old. Specialty and gender influenced the likelihood of being sued. For example, general surgeons and ob-gyns, as well as men physicians, had the highest risk, per the AMA report.

Musings on a Famous Portfolio Asset Allocation Study

Some Critics Claim Brinson, Hood, and Beebower Conclusions Wrong

Frequently, we hear the axiom that asset allocation is the most important investment decision, explaining 93.6% of portfolio returns. The presumption has been that once the risk tolerance and time horizon have been established, investing is simply a matter of implementing a fixed mix of stocks, bonds, and cash using mutual funds selected for this purpose. This axiom is based on a famous study by Brinson, Hood, and Beebower (BHB) published in the Financial Analysts Journal in July/August 1986. It is the stuff of most modern business school and graduate students in economics and finance.

Enter the Critics

One critic claims that BHB’s conclusions and the interpretation of their conclusions are wrong, stating that because of several methodological problems, BHB needed to make certain assumptions for their analysis to go forward. They assumed that the average asset-class weights for the 10-year period studied are the same as the actual normal policy weights; that investments in foreign stocks, real estate, private placements, and venture capital can be proxied by a mix of stocks, bonds, and cash; and that the benchmarks for stocks, bonds, and cash against which fund performance was measured are appropriate. The author believes that each of these assumptions can lead to a faulty measurement of success or failure at market timing and stock selection.

The Jahnke Study

William Jahnke claims that BHB erred in their focus on explaining the variation of quarterly portfolio returns rather than portfolio returns over the 10-year period studied. According to the study, asset allocation policy explains only a small fraction of the range of 10-year portfolio returns earned by the pension funds reported in the study. The author concluded that this discrepancy is caused by the effect of compounding returns. He adds that BHB were wrong to use variance of quarterly returns rather than the standard deviation. Use of standard deviation would reduce the often cited 93.6% to about 79%. Moreover, BHB did not consider the cost of investing, such as operating expenses, management fees, brokerage commissions, and other trading costs, which are more significant for individual investors than for the pension plans studied. Jahnke claims that excessive costs can reduce wealth accumulation by 50%.

Assessment

Finally, the author takes issue with establishing long-term fixed asset class weights. Asset allocation should be a dynamic process. Higher equity return expectations should in turn produce larger equity allocations, other things being equal.

The Legacy of Dr. Jack Treynor

The History Behind A Popular Investing Theory

In his 1959 “Portfolio Selection,” Harry Markowitz PhD [father of MPT], said that investors should diversify against market risk but that determining the required return from such a group of diversified assets was another matter. Seven years later, economist Jack Treynor PhD wrestled with the issue of how investors can measure the expected risk in a portfolio against its expected return. Meanwhile, William Sharpe developed his own measure of risk and return known as the Capital Asset Pricing Model (CAPM) first published in the Journal of Finance in 1964 and discussed elsewhere on the ME-P.

A Seminal Paper

Treynor’s 1961 paper entitled “Toward a Theory of Market Value of Risky Assets” concluded that investors expect greater compensation for the larger risk they take in the stock market than they do from risk-free assets, such as Treasury bills. He called it the “equity risk premium” and created a method to predict it.

Fisher Black Collaboration

In 1973, Treynor collaborated with Fischer Black to devise a method for predicting the risk premium and to demonstrate its overarching importance in the behavior of capital markets as well as in portfolio selection. From 1969 through 1981 he furthered the work of many leading financial theorists, including Sharpe and Black, when he edited the Financial Analysts Journal.

Intellectual Band-Aid

In an interview about a decade ago, Treynor stated his belief that modern finance is preoccupied with statistical, rather than economic, thinking about risk. He explained that beta has come under attack in recent years because it is a statistical concept of risk. An economic concept of risk would have a lot more predictive value—it would be tied more intimately into fundamental analysis of companies and portfolios. He refers to beta as “just an intellectual Band-Aid.”

The Jensen Alpha

Treynor also described Bill Jensen’s alpha as looking at a market line established by a large number of funds and identifying those that had returns above the market line. Accordingly, a portfolio manager can increase his or her alpha by simply buying and selling larger positions of the same research recommendations.

Assessment

Black and Treynor developed a ratio of alpha to residual risk (return squared /risk squared), which shows that when you have everything else equal and you increase this ratio, you improve performance. And, they actually introduced the term Sharpe ratio.
