NewYork-Presbyterian Hospital recently introduced a new personal electronic health record [eHR] enabling patients to access medical information wherever and whenever they need it. Called myNYP.org, the system uses Microsoft’s HealthVault and Amalga technologies to offer patients the ability to select and store personal medical information generated during visits to NewYork-Presbyterian.

Medical Practices Must Have Plans for Handling Health Data Breaches
It does not matter whether you are a solo physician in a small rural setting or an employed physician in a large urban hospital, starting September 23, if patients’ personal data are leaked, you have to let them know.
This could mean sending a letter to the patient or patients affected or taking out a quarter-page ad in the local newspaper, depending on the type of breach.
Additionally, even if a breach never occurs, the new rules require practices to have a plan in place — just in case.
The new breach notification rules, sanctioned by the American Recovery and Reinvestment Act [ARRA], were issued by the U.S. Dept. of Health and Human Services [HHS] in August. Unlike former HIPAA rules that did not specify a time frame for action to be taken post-breach, the new rules give very specific deadlines. The law says the practice should take action immediately, no later than within 60 days.

Disappointment in EHRs Mount
As the expressed disappointment of EHRs becomes louder and louder, just in case you might have forgotten: “PR Firm [Ketchum Inc.] Behind Propaganda Videos Wins Stimulus Contract,” by Sebastian Jones and Michael Grabell for ProPublica, March 30, 2010).

Jones and Grabell write:
“President Obama’s push for electronic medical records has faced resistance from those who question whether health information technology systems can protect patient privacy.
So last week, the U.S Department of Health and Human Services hired a public relations firm to try to win consumer trust.”
Four years later, HHS is losing trust so badly that even Ketchum propaganda can no longer save them.
