  2. Doctors Win First Safe Harbor Against ACA Use in Liability Suits

    Physician leaders hope a first-of-its-kind bill approved in Georgia protecting doctors from civil liability for breaching federal health system reform requirements will be replicated in other states.

    Medical associations long have been concerned that federal quality-of-care and payment reform measures, such as those authorized by the Affordable Care Act, could be used to fuel negligence accusations against individual physicians.

    The Georgia law, drafted from American Medical Association model legislation, prevents such health reform metrics from being used as evidence in liability cases. Georgia’s law states that payer guidelines and quality criteria under federal law shall not establish a legal basis for negligence or a standard of care for the purposes of determining medical liability.

    The Arkansas legislature’s approval of a private alternative to the ACA Medicaid expansion responds to the concern many states have about growing a public program. Nearly half of state governors are currently leaning against or are undecided on the Medicaid expansion.

    If these states follow their governors’ pronouncements, an estimated 6.4 million low-income, uninsured adults are at risk of remaining without insurance. Hospitals, employers and the privately insured also stand to lose in states that opt out.

    According to an issue brief by the Kaiser Family Foundation, the Affordable Care Act implementation drives related Medicaid enrollment and spending growth. Below are Medicaid enrollment and spending growth figures:

    • 8.3% enrollment growth (FY 2014).
    • 10.2% total spending growth (FY 2014).
    • 6.4% state spending growth (FY 2014).
    • 13.2% enrollment growth (FY 2015).
    • 5.2% state spending growth (FY 2015).
